TERMS AND CONDITIONS
1.1 The Promoter of this Campaign is Samsung Electronics South Africa (Pty) Ltd, a private company with limited liability, duly registered and incorporated in accordance with the company laws of the Republic of South Africa, having its registered office at 2929 William Nicol Drive, Bryanston, Johannesburg, 2021.
1.2 The Promoter has the exclusive right to promote the 4-6-6-6-4 campaign, such that where a Proteas batsman or the Proteas team in a Qualifying Match strikes 4-6-6-6-4 in consecutive boundaries (not consecutive deliveries), the Promoter has agreed to donate R1,000,000.00 (one million rand) to the Nelson Mandela Foundation Trust (“the Campaign”). Any run scored off the bat between the sequence of boundaries (excluding extras) will nullify the sequence with the result that the relevant Proteas batsman or the Proteas team will start the sequence again. For example, a single will nullify the sequence, but a wide or leg bye or “dot ball” will not nullify the sequence. For the avoidance of doubt, the relevant sequence may occur over the course of more than one over.
1.3 This document has been published to inform the public about the Campaign and confirm in writing the terms and conditions (“the T&C’s”) which apply to the Campaign. These terms and conditions shall be binding on all those who participate in the Campaign. In the event of a discrepancy between these terms and conditions and other promotional material produced in respect of the Campaign, these terms and conditions shall prevail.
2.1 Clause headings are inserted for convenience only and shall not be used in its interpretation.
2.2 The following expressions shall bear the following meanings and related expressions bear corresponding meanings
“Campaign” shall mean the “Samsung 4-6-6-6-4” Campaign as described herein;
“Campaign Period” shall mean the period from 26 December 2015 until 30 September 2017;
“Donation” shall mean the donation which shall be made to the Foundation upon achievement of the sequence as more fully set out in clause 3 below;
“Event of Force Majeure” shall mean any event beyond the reasonable control of Samsung, including but not limited to war, earthquakes, disasters, calamities, storms, power failures, strikes or similar circumstances (including the threat thereof) or the postponed, curtailment or cancellation of the Qualifying Match for whatever reason;
“Foundation” shall mean the Nelson Mandela Foundation Trust;
“Promoter” shall mean Samsung Electronics South Africa (Pty) Ltd;
“Proteas” means the men’s national cricket team; and
“Qualifying Match” means any international match played in South Africa during the Campaign Period featuring the Proteas (including any One-day International, T20 International or Test Match).
3.1 The Promoter has agreed to make a donation of R1,000,000.00 (one million rand) to the Foundation should a Proteas batsman or the Proteas team strike 4-6-6-6-4 in consecutive boundaries (not consecutive deliveries) during a Qualifying Match. Any run scored off the bat between the sequence of boundaries (excluding extras) will nullify the sequence with the result that the relevant batsman or team will start the sequence again. For example, a single will nullify the sequence, but a wide or leg bye or “dot ball” will not nullify the sequence. For the avoidance of doubt, the relevant sequence may occur over the course of more than one over.
3.2 The Promoter will review the sequence referred above in consultation with the official scorer and will be responsible for confirming publicly both the validity of the occurrence and the payment of the Donation to the Foundation.3.4 The Promoter may refuse to award the Donation if these terms and conditions have not been met or if it detects any irregularities or fraudulent practices with respect to the Campaign or the occurrence of the relevant sequence.
GENERAL TERMS AND CONDITIONS
4.1 The award of the Donation is subject to the following additional terms and conditions:
4.1.1 The Campaign will run for the duration of the Campaign Period;
4.1.2 If the relevant sequence is achieved, the Donation will be awarded to the Foundation by a representative of the Promoter at a presentation upon completion of the cricket match in question.
4.1.3 The Donation:
(a) shall be paid to the Foundation by the Promoter as soon as reasonably possible following completion of the presentation;
(b) shall be deposited directly into the bank account of the Foundation;
(c) cannot be transferred to any other person or company other than the Foundation; and
(d) will not be exchanged for any donation other than the Donation awarded in this Campaign.
4.1.5 Only the players participating in the Qualifying Match during the Campaign Period shall be entitled to participate in the Campaign. The sequence may only be achieved by Proteas players participating in the Qualifying Match. For the avoidance of any doubt, the achievement of the sequence by a player from a visiting international team shall not constitute a successful attainment of the sequence for the purposes of the Promoter making the Donation.
4.1.6 The Promoter is entitled to amend the T&Cs insofar as it deems necessary and appropriate and such amendments may relate to any aspect of such Campaign. The amendments may include the addition and/or deletion of any terms and conditions of the Campaign, including those relating to payment of the Donation. The proposed amendments may be effected prior to the start date of the Campaign or during the Campaign Period.
4.1.7 Any disputes arising in relation to this Campaign shall be dealt with by the Promoter. Representations relating to the Campaign may be made in writing to the Managing Director of the Promoter, who, upon deliberation on such representations, shall decide upon the matter in his absolution discretion.
